Homeowners Meeting Minutes
28th November 2006

7PM AT THE AMERIHOST, CAROLINA BEACH ROAD, WILMINGTON

Present for the board:
Tom Perry (President and Chair)
Dean Webb (Vice President)
Peggy O’Leary (Treasurer)
Teresa VanDamme (Secretary)
Neal Bradshaw (Member At Large)

Total Number of Homeowner Voters Present: 10 (One vote per household)

1. As 50% of homeowners were not represented a motion was made to suspend the rules of quorum and this was carried unanimously.

2. The minutes of the last meeting (and intervening board meeting) were read and the secretary gave her report.

3. The Treasurer gave her report. The issue was raised that many homeowners are failing to pay the prescribed dues. It was agreed that a statement would be sent to all homeowners at the beginning of 2007 outlining monies due and outstanding balances for each household. The Member At Large volunteered to undertake collection activities, should this become needed.

4. The next Yard Sale was set for Saturday April 21st (April 28th as rain day) and the next meeting was set for Tuesday March 13th at the Amerihost on Carolina Beach Road at 7PM. At that meeting invoices for the following years dues will be available for collection.

5. The outstanding debt to the association by the builder of $9100 was raised. A Motion was made and carried unanimously that a sum of not more than $100 would be allocated to Tom to investigate legal action to recover these funds. His findings will be presented at a board meeting in January at which time a decision will be made about the most effective way to proceed. Homeowners will then be notified of this decision.

6. Another homeowner agreed to investigate obtaining liens against homeowners who have refused to pay dues and would report back at the next full meeting.

7. The issue of a very few homeowners failing to meet property maintenance standards provided in the covenants was raised and it was agreed that solutions to this problem would be investigated. It was again pointed out that, even in the case of rented property, it is the owner’s responsibility to maintain the property to the accepted standard.

8. The problem of the faulty sprinkler system was raised and it was agreed that this be investigated to see what was causing the problem of leakage.

9. The ongoing resident alligator issue was raised and it was unanimously agreed that a sign would be put in place as soon as possible to warn against feeding.

10.Annual elections were held and the results as follows:

Neil Bradshaw Re-elected as Member At Large (1 Year)
Han Hills Elected as Secretary (1 Year)
Dean Webb Re-elected as Vice-President (1Year)
Tom Perry Re-elected as President (3 Years)

11.In other business a new couple to the area expressed a need for a full set of the covenant and it was discovered that parts are missing from the website. A full version is to be compiled ASAP and made available for distribution electronically and in hard copy as needed.

Finally: The motion was made to re-instate the rules and carried unanimously.

BLOCK PARTY AND HOMEOWNERS MEETING - JUNE 10th

Minutes from the June 10 Block Party

Thanks to the committee for set-up & to Mr. Bradshaw for cooking the pig - which was delicious.

Concerns:
There is major concern about the Speeding Vehicles through our complex. Some Suggestions.
Discussion about Stop Sign Violations.
One of our resident Wilmington Police Officers has ticketed a number of vehicles for going through the stop signs, but he is not always around.
Blocking the opening between the two developments.
Roads are controlled by Dept. of Trans. and we cannot close the opening. Everyone in the development was under the knowledge that this road was to be blocked and there was not to be access. The developer decided differently, and road cannot be blocked now.

Roads turned over to Dept. of Trans:
Using this turnover as leverage for the developer to reimburse the H.O.A. $9,100 taken from each original buyer to be held in Escrow until Association was turned over to a Board of Directors as mandated in the by-laws. This money was to be held in Escrow and all interest accumulated over the period of time was to be turned over to the Board of Directors and placed into the bank account of the H.O.A.. The developer has refused to turn over these funds.

Alligator Issue:
Much discussion regarding the alligator and our responsibility for his presence. The Alligator is a special concern species of the area has all rights to remain in the retention pond. We need to be the caretakers. Alligators will remain wild and not attack people if:
Per the NC Wildlife - Leave him alone - Do Not Feed, because he becomes less cautious of humans and will begin to come closer to the edge of the pond when humans are around and then may attack a small dog or cat. There are licensed people to remove problem gators but when removed it only opens the space for another to locate in the pond.

Green Spikes will be removed.

Landscaping entry of old accident site. Issue will be addressed.

Thanks to Dean and Courtney for the planting in the entry island.

Concern about children in the road. Requesting parents to please speak to children about the danger of vehicles racing through the sub-division.

DONT FEED THE ALLIGATOR!!!

As many Linden Ridge residents have known for some time we have a small alligator living in the pond on Hedingham Lane.

Just as it is against Federal Law to harm this Alligator it is also against the law to feed it and so we would ask residents and visitors not to do so.

Apart from the legal issues, feeding our uninvited resident will only encourage him to venture out into the neighborhood where he could present a danger to our pets and children.

BORDER PROTECTION ON LINDEN RIDGE RD


The new green stakes that have been put up to protect the verges from drivers who mount them while entering Linden Ridge or performing U-Turns.

In the long term these should be replaced by a shrub border.
